For years, every FDA certificate in a Vietnamese registration file had to be authenticated in Washington and then consularly legalized by the Embassy of Vietnam, which added cost and a week or more of waiting. Vietnam deposited its accession to the Apostille Convention on 31 December 2025, and the Convention took effect there on 11 September 2026. Germany, Austria and Czechia objected to the accession, but the United States did not, so U.S. public documents now qualify for an apostille.
That matters because Vietnamese regulators insist on legalized proof from the country of origin. Dossiers for imported health supplements, for example, need a certificate of free sale, export certificate or health certificate from the exporting country that, under Decree 15/2018, had to be consularly legalized; an apostille now does that job. The FDA is a federal agency, so only the U.S. Department of State can apostille its certificates, and we arrange it for you.

Vietnam's Ministry of Health oversees medicines, devices, supplements and cosmetics through different departments, and food safety is shared with other ministries. Your Vietnamese importer or registration holder will confirm the authority and the FDA certificate it needs.

Exporting to Vietnam: What to Prepare
Apostille timing
Only documents filed on or after 11 September 2026 benefit from the apostille. Certificates already legalized by the embassy before that date remain valid, so you don't need to redo them. During the transition, some local offices may be slower to recognize apostilles, so ask your importer to confirm.
Faster drug approvals by reference
Vietnam amended its Law on Pharmacy in November 2024, with most changes in force from 1 July 2025. Dossiers that can rely on assessments by stringent regulators such as the FDA have a 9-month appraisal period instead of 12, and renewals for imported drugs need a valid CPP.
Devices by risk class
Under Decree 98/2021, Class A and B devices are declared to provincial Departments of Health, while Class C and D devices need Ministry of Health registration through the online portal. Registration numbers for devices do not expire, so the legalized documents you file now carry long-term value.
Vietnamese translations
Foreign-language documents in Vietnamese dossiers need a notarized Vietnamese translation. Apostille the FDA certificate first and translate it afterwards, so the translation covers the apostille as well.

Does Vietnam accept apostilles now?
Yes. The Hague Apostille Convention has applied to Vietnam since 11 September 2026, and the United States did not object. A U.S. Department of State apostille replaces legalization by the Embassy of Vietnam.
Do I still need Vietnamese embassy legalization for FDA certificates?
Not for documents filed on or after 11 September 2026. Certificates already legalized before that date stay valid. Countries that objected to Vietnam's accession, such as Germany, still use legalization, but that doesn't affect U.S. documents.
How long does it take and what does it cost?

Who regulates medicines and supplements in Vietnam?
The Drug Administration of Vietnam handles medicines and cosmetics, and the Vietnam Food Administration handles health supplements and food safety, both under the Ministry of Health.
